This Terms of Service applies to your use of the Skillplay.me website and the Skillplay service (collectively “Skillplay Education” or “Skillplay”), as well as your relationship with Skillplay group and its affiliates and service providers (hereinafter referred to as “Skillplay” “we” “us” or “our”).
Please stop using the service if you disagree with these Terms, including the class action waiver and the mandatory arbitration clause that are both mentioned below.
These conditions are subject to change. If we modify the Terms in a small way without significantly affecting your rights, we'll post the updated terms on our website. If we make a change that fundamentally alters your rights, we will give you notice by email, through the Skillplay Service, or by presenting you with a new set of Terms of Service to approve. You indicate your acceptance of the new terms by continuing to use the Skillplay Service following the posting of a modification.
If you have a written agreement with Skillplay that specifies that it takes precedence over these Terms of Service (for instance, if you are a University or Employer Partner), then the rules of your separate agreement will take effect in the event of a discrepancy between the two contracts.
Because Skillplay values user privacy, it forbids third parties from using automated scripts (also known as "scraping"), comparable or other technologies or methodologies to gather in bulk student data, employer data, job descriptions, or other marketplace information from our Services. Please see our Privacy Policy for more details on our privacy practices.
Account Creation
In order to use Skillplay, you must have an account. As a student looking for employment or career guidance, a company seeking fresh, fascinating talent, or a career centre professional, you can register an account on Skillplay. You acknowledge that when creating or using an account, you will not give false information about yourself.
Creating a Student Account Linked to Your University: If you are a student at a Skillplay University Partner ("University Partner"), you are eligible to make a Student Account. In order to handle their internal and external career centre operations, such as scheduling meetings with students, planning events, and distributing resumes to potential employers, University Partners use Skillplay as a service provider. In order for Skillplay to offer these services, University Partners must send us personal data about their students when they join up for Skillplay.
You'll receive an email from your university with instructions on how to enable your student account. When you do this and we verify that you are affiliated with our university partner, we pre-fill some of the information in your profile with data from your university. We urge you to check this data for accuracy and comprehensiveness. Your university might have restricted some of this data, making it impossible for you to change it through Skillplay. If any errors are discovered, kindly notify your university or change the information as necessary.
Creating a Student Account Without a University Partner: If your school is not a University Partner, you can still create an account on Skillplay by reaching out to us at info@skillplay.me.
When creating your student account, you have the choice to add extra details like a profile photo or a list of your professional qualifications. You may also upload documents like your resume or transcript. These Terms apply to any data or content you submit directly to the Skillplay Service.
You must be at least 16 years old to register a student account and utilise this service. To use the Service if you are under the age of 16, please have a parent or legal guardian complete this form and submit it here.
Student Account Guidelines
For companies around the nation, your Skillplay profile serves as your first impression. Always keep your discussions and content on Skillplay professional. Particularly, you are prohibited from posting any violent, nude, sexist, racist, or otherwise objectionable content on the Service. All content that you publish to Skillplay belongs to you.
Through the Service, you can communicate with employers and other students, including those who attend different Universities or academic institutions, by seeing their profiles and sending messages. You consent to refrain from impersonating other individuals or entities, stalking them, or bullying, harassing, or abusing them. Additionally, you promise not to use Skillplay in any way that is unlawful or unauthorised, such as for spam, copyright violations, identity theft, or fraud.
You promise that you won't make any effort to prevent another user from using or enjoying the Service, and that you won't incite or assist in breaches of any other Skillplay rules or these Terms of Service.
Making Your Profile “Public” or “Private”
When students first activate or create their Skillplay account, they are offered the option to make their profile as "private" or "public." When a student changes their profile to "public," they also have control over who others can view and access it. Student data submitted to Skillplay by the University is by default private for Student Accounts started by University Partners.
Employers and other students cannot view any information about you if your profile is set to "private," however if your student account is linked to a University Partner, the University Partner will be able to see certain information on your profile, even if it is set to private. Where available, private profiles can still access all placement coordinator account features like appointments and scheduling. When your profile is set to private, you can still RSVP for career fairs or events and apply for jobs, but only a limited amount of information in your profile will be visible to the relevant employer(s), such as your name, primary contact email, the university you attend, and your educational institution (engineering, liberal arts, etc.) —However, any other personally identifiable information in your profile—including your profile picture, GPA, sponsorship status, list of qualifications, bio, and resume—will be obscured or masked.
By accessing User Settings from the Account Dashboard, you can modify your privacy settings while your account is active. This includes making your GPA, which is by default private, public or switching your profile from public to private.
Recording of Skillplay Communications
Some jurisdictions forbid recording people without their knowledge or agreement due to wiretapping laws. It is against the law to start an audio or video recording of a third party. By starting any audio or video recording using the Service, you represent and warrant that all participants have given their express permission for any and all prospective uses by Skillplay of the audio or video recording, as may be required by law. You acknowledge that you will not hold us accountable and that we will not be liable for your failure to follow applicable laws, to let people know that you are recording them, or to get their permission before doing so.
Continuing Support
Skillplay is dedicated to assisting you in achieving professional success both during and after school. We advise you to maintain your profile up to date and to update your contact information with a personal email address so that you can continue to access your profile once your student email address expires. These Terms and our Privacy Policy apply to any information you directly disclose with Skillplay.
Creating an Employer Account
Creating an Employer Account: To create an Employer Account, you must either sign up for a new Employer Account or join forces with an existing Skillplay Employer Partner ("Employer Partner"). Except with the express permission of an employer or client to create an account on their behalf, you may not create an account for any person other than yourself. Employer Partners cannot access any student profiles unless Skillplay or the student's university give them permission to do so in order to access student information that the student decides to provide.
In order to provide a point of contact for administrative staff and universities, we ask for contact information when you register a Skillplay Employer Account. This information is made public on your profile. When creating an account, you have the choice to set your profile to "public" or "private." You can later adjust your account's visibility by accessing User Settings from the Account Dashboard. Your phone number won't be used by us to contact you with any unsolicited marketing or commercial calls from third parties. Vendors who assist us in preventing or detecting fraud or other misuse of our services may receive your data. You acknowledge that you will give true, up-to-date information and that you will fix any errors as soon as you become aware of them. By opening an Employer Account, you affirm that you are the owner of, or have obtained all necessary authorizations for, Skillplay to access and process any data, materials, or information you provide to Skillplay. You also give Skillplay permission to access, use, and display such information for the purposes of providing the Service.
All institutions will have access to the data you enter when creating a Skillplay Employer Account. You can only share that information with students if you make your profile public. You will receive student data through our Service once partner Universities have approved your account. You promise to keep student data private and are forbidden from revealing or sharing it with third parties. You may not use, sell, or disclose Skillplay Data for any reasons, including data analytics, data monetization, advertising, marketing, or any other purpose, even if such Skillplay Data is aggregated or de-identified. You may only use student data to offer the employer services to the student. Additionally, you agree not to send spam or any other illegal messages using the Service and not to utilise any student data that is gathered for activities that are not approved by Skillplay. More information about these restrictions is provided below.
Employer Account Guidelines
You will be able to search and filter student results using Skillplay based on a variety of parameters. You acknowledge that while choosing student candidates, a fair and equitable recruitment procedure must be upheld. Additionally, as forbidden by law, you promise to refrain from discrimination on the grounds of race, national origin, religion, age, gender, sexual orientation, disability, or veteran status. Through the Service, you can speak with students directly. You acknowledge and agree that using our Service does not constitute stalking, defamation, bullying, harassment, abuse, threats, or impersonation of any person or entity.
Employers' appointed account administrators are in charge of managing Employer Accounts. You acknowledge that the account administrators are accountable for the use of the Service by any additional individual workers that the employer decides to grant access to through the Employer Account, including any requests connected to personal data gathered from those additional individual employees. With regard to your access to the Skillplay Service, you acknowledge and agree that Skillplay is not liable for the privacy or security practises of your organisation, which may differ from but not necessarily be less protective than, these Terms or our Privacy Policy.
Furthermore, you understand and agree that Skillplay may examine the application process for any new position before it is made available to candidates on the Skillplay Service in order to verify your compliance with these Terms.
Third Party Recruiter Guidelines
The goal of Skillplay is to provide students with as many professional options as possible, including those provided by outside recruiters. However, we do not allow third-party services to mass collect information about students, employers, jobs, or the job market using automated scripts (sometimes known as "scraping") or other comparable or alternative technologies or approaches. Furthermore, you are not permitted to use the data of students or other users for the purpose of promoting any employment possibilities other than the opportunity the applicant applied to through the Skillplay Service in order to safeguard our users' privacy and their data. For the same reason, you are not permitted to hold any student or other user's data in order to (1) inform applicants of future employment prospects, or (2) permit any third party to use the data for marketing or any other purpose. Additionally, it is against the law for third-party recruiters to demand that students register on a website that is not associated with the business or brand that is offering the job. The linked account(s) with you or your recruitment service may be suspended or terminated as a result of any breach of these or any other Terms, at our discretion.
No Spam
Employers and recruiters should be able to engage with students and other users on Skillplay in a way that benefits everyone. As a result, even while we permit recruiters and employers to get in touch with students and other users, you are not permitted to use the Service to send unsolicited commercial e-mails or broadcasts (i.e., spam).
Our policies, which aim to address a variety of inappropriate content or messaging, include but are not limited to:
Unsolicited messages with the intention of directing users of the Skillplay Service to accounts, websites, goods, or projects that are not directly associated with a job opportunity that has been advertised on the platform.
Bulk, repeated, same communications, or messages in huge number with a poor response rate from students
Messages that do not adhere to the rules and legislation governing anti-spam.
Any action we deem necessary to safeguard our users' experiences or the Service may be taken if we find that you have sent spam or other unlawful content, including demanding that you stop violating these Terms, suspending your student messaging privileges, or suspending or terminating your account(s).
Employer Paid Services
To improve the Skillplay experience, Skillplay may provide Employers with some paid upgrades, additions, or other premium Services ("Paid Services"). The use of Paid Services is contingent upon the payment of fees ("Fees"), which are set by Skillplay and are subject to change at any moment. All charges are made in AED and are not refundable. They might be made by one of our affiliates and handled by a third party payment processor. Additional terms and conditions may be offered to you at the time of purchase, access, or download for some Paid Services and payment processing gateways. Skillplay reserves the right, at any time, and at its sole discretion, to accept or reject any order, or to limit the number of items purchased.
Paid Services might comprise a subscription that, in accordance with the conditions of the subscription, renews on a monthly (or other periodic) basis. Paid Services subscriptions automatically renew at the end of each subscription month for a renewal period of equal duration at the then-current Fees applicable to the Paid Service, unless cancelled prior to the end of the then-current subscription period. By subscribing to a Paid Service, you recognise and agree that it will renew automatically in accordance with the foregoing terms, and you authorise us to charge your payment method for the renewal term until you cancel your membership. By going to your account management section, you can stop your subscription from renewing automatically at any time. You won't get a prorated refund when you cancel a membership, but you'll still have access to the Paid Services for the duration of the period in which you did it.
All applicable local, state, federal, or foreign taxes, levies, or charges of any kind, including value-added, sales, use, or withholding taxes, shall be your responsibility to pay ("Taxes"). If Skillplay is required by law to pay or collect Taxes for which you are liable, you will be charged and required to pay the appropriate sum. You authorise Skillplay to request and collect payment through our payment provider as well as to conduct any checks required to verify your selected payment account or financial details by starting an order for Paid Services. Skillplay retains the right to cancel your order without prior warning and without additional liability or obligation to you if your payment method is unsuccessful, not allowed, or not accepted. If we choose to cancel your order as a result of your failure to pay any Fees that are owed to us, you will nonetheless be liable for any unpaid Fees.
By paying for Paid Services, you acknowledge that your use of those services must be for your own internal use alone, as intended by Skillplay, and that you have no right to assign that use or to resell, replicate, or distribute it in any way. For breaking these Terms of Service, Skillplay reserves the right to discontinue any Paid Services.
Placement Coordinator Accounts
Data is still accessible to placement coordinators as part of their administrative responsibilities. Placement coordinators have access to every student profile linked to their university, including concealed information and private accounts.
General Guidelines for Students and Employers
The Content You Submit Belongs to You
Any content that you submit on or through the Service does not belong to Skillplay. You give Skillplay a non-exclusive, transferable, sublicensable, worldwide, royalty-free licence to use, duplicate, modify, publicly perform, and distribute Your content only in connection with running and offering the Skillplay Service when you make Your content available on or through the Service.
Your Content is your responsibility. You guarantee and indicate that Your Content is either your property or that you own all the rights necessary to grant us permission to use it in accordance with these Terms. Additionally, you guarantee that the following will not happen with respect to Your Content: (a) any infringement, misappropriation, or violation of a third party's patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights to publicity or privacy; (b) any violation of, or encouragement of a violation of, any applicable law or regulation that would result in civil liability; and (c) any fraudulent, false, or misleading statements; d) advocate illegal or harmful behaviours or substances. e) be defamatory, obscene, pornographic, vulgar, or offensive. f) promote discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group. g) be violent or threatening, or promote violence or actions that are threatening to any person or entity.
Our Intellectual Property Belongs to Us
As between you and Skillplay, Skillplay owns and retains all rights to the Service and Skillplay Content. Skillplay Content is protected by copyright, trademark, patent, trade secret, and other laws. You agree not to remove, change, or obfuscate any copyright, trademark, service mark, or other proprietary rights notices included in or accompanying the Skillplay Content. You also agree not to duplicate, modify, or otherwise exploit our Content by performing, displaying, publishing, disseminating, transmitting, or broadcasting it.
Without our prior written consent, you may not copy, duplicate, or otherwise use, in any way, the Skillplay name or logo in whole or in part. Additionally, Skillplay's service marks, trademarks, and/or trade dress include all page headers, custom graphics, button icons, and scripts, all of which are not to be duplicated, imitated, or used in whole or in part without prior written consent.
Termination
In the event that you violate these Terms of Service or any other policies governing the Services, we retain the right to suspend or terminate your account(s).
Account and Website Security and Integrity
While we take precautions to prevent unauthorised access to your data, security is a team effort. You are in charge of maintaining the confidentiality and security of your password, and we advise you to change it frequently.
By using this Service, you consent to refrain from altering it or making it appear as though it is affiliated with another website. It is forbidden to create accounts by unauthorised methods, such as scripts, bots, or automated crawlers, and it is also forbidden to gather content by crawling, scraping, or caching user profiles without our prior permission.
You may not try to prevent another user from using or appreciating the Service, and you may not promote or assist in violations of these Terms of Service or any other Skillplay rules.
No Monitoring
Your interactions with other Service users, whether online or offline, are entirely your responsibility. You acknowledge that we are not liable or accountable for your actions. We reserve the right to monitor disagreements between you and other users but are under no obligation to do so. When dealing with people, including when you publish or post Content or any personal or other information, use common sense and your best discretion.
Third Party Links
Our service includes links to outside of Skillplay's control third-party websites, mobile applications, services, and resources (collectively "Third-Party Services"). We don't control the information, goods, or services made accessible through Third-Party Services, therefore we simply offer these links as a convenience. You accept full responsibility for using any Third-Party Services and all associated risks.
Violation and Enforcement of These Terms
We retain the right to revoke anyone's access to the Service at any time and for any reason. Any username or account may be required to be forfeited at any time for any reason. We may remove, alter, block, and/or monitor Content or accounts containing Content that we deem in our sole judgement violates these Terms of Service, but we are under no obligation to do so.
Controlling Terms
In order to further enhance our service, Skillplay occasionally offers specialised features or functionalities that come with additional Terms of Service. The extra Terms take precedence over the terms listed below if any of them are in disagreement.
Reporting Copyright and Other IP Violations
We respect the rights of others, and we anticipate that you will do the same. In the event that you violate someone else's intellectual property rights, we will disable your account as necessary.
Disclaimer of Warranties
The service is offered "as is," "as available," and "with all defects," including, but not limited to, Skillplay material. To the fullest extent allowed by law, neither Skillplay nor any of its partners, employees, managers, officers, or agents (collectively, the "Skillplay parties") make any representations or warranties or endorsements of any kind whatsoever, express or implied, as to: a) the service; b) the Skillplay content; c) user content; or d) the security related to the transmission of information to Skillplay or via the service. The Skillplay parties further expressly and expressly disclaim any and all implied warranties, including, but not limited to, the implied warranties of merchantability, suitability for a specific purpose, non-infringement, title, custom, commerce, quiet enjoyment, system integration, and virus-free status.
The Skillplay parties do not guarantee or represent that the service will be uninterrupted or error-free, that flaws will be fixed, or that the server hosting the service is devoid of any potentially harmful elements, including but not limited to viruses. The Skillplay parties disclaim any claims or warranties regarding the accuracy, usefulness, or completeness of the information (including any instructions) on the service. You agree that using the service is done at your own risk. The Skillplay parties expressly disclaim making any claims about the legality of your use of the service in any given jurisdiction. The above disclaimer may not apply to you to the extent that the legislation of such jurisdiction is applicable to you and these Terms of Service because certain jurisdictions restrict or do not permit the disclaimer of implied or other guarantees.
You represent and warrant that your activities are legal in all countries where you access or use the service by accessing or using the service.
The Skillplay parties expressly deny any responsibility or liability for any loss, damage (whether actual, consequential, punitive, or otherwise), injury, claim, liability, or other cause of any kind or character based upon or resulting from any content and specifically state that they do not endorse any content.
Users hereby provide all permissions necessary for the services to function in accordance with these Terms of Service.
Limitation of Liability; Waiver
The Skillplay parties will not, under any circumstances, be responsible to you for any loss or damage of any kind (including, without limitation, for any direct, indirect, economic, exemplary, special, punitive, incidental or consequential losses or damages) that is connected to any of the following: (a) the service; (b) the Skillplay content; (c) user content; (d) your use of, inability to use, or the performance of the service; (e) any action taken in connection with or (h) any damage to any user's computer, smartphone, or other technology, including, without limitation, damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure, or any other technical or other malfunction, including, without limitation, damages for lost profits, loss of goodwill, loss of data, work stoppage, accuracy of results, or other types of malfunction, whether in a negligence, strict responsibility, or tort action, even if foreseeable or even if the Skillplay parties were informed of or should have recognised the likelihood of such damages (including, without limitation, whether caused in whole or in part by negligence, acts of god, telecommunications failure, or theft or destruction of the service). The Skillplay parties shall never be held responsible for any loss, damage, or injury to you or anyone else, including but not limited to, wrongful death or physical injury. The above limitation or exclusion may not apply to you because some states do not permit the exclusion or limitation of incidental or consequential damages.
You acknowledge and agree that in the event that you suffer any damages, losses, or injuries as a result of Skillplay's actions or inactions, the damages, if any, will not be irreparable or great enough to entitle you to an injunction preventing the exploitation of any website, service, asset, product, or other content owned or controlled by the Skillplay parties. Additionally, you acknowledge and agree that you will not have any rights to enjoin or restrain the creation.
You release Skillplay, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you may have against any such third parties. Skillplay is not liable for the conduct, statements, information, or data of third parties.
Indemnification
Unless otherwise prohibited by law, you agree to defend the Skillplay Parties from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with any of the following (including as a result of your direct activities on the Service): Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right; (ii) Your access to or use of the Service; (iii) Your Content; (iv) Your violation of any laws, rules, regulations, codes, statutes, ordinances, or orders of any governmental or quasi-governmental authorities, including, without limitation, all regulations, you agree to assist Skillplay in the defence of any claim to the fullest extent possible. You agree that you will not in any way settle any claim without Skillplay's prior written approval and that Skillplay maintains the right to take sole responsibility for the defence and management of any case for which you are obligated to indemnify Skillplay.
Dispute Resolution
You acknowledge and agree that the arbitration process described below shall apply to any dispute between you and Skillplay arising out of or connected to these Terms of Service, the Skillplay Service, or any other Skillplay goods or services (collectively, "Disputes").
Informal Dispute Resolution: Without the need for a formal court case, we want to address your problems. You consent to first contact us here to attempt an informal resolution of the Dispute before bringing a claim against Skillplay. We'll get in touch with you via email and attempt an informal resolution of the Dispute. You or Skillplay may file a formal process if a dispute isn't settled within 15 days after submission.
We Both Agree To Arbitrate: Except as provided under Exceptions to Agreement to Arbitrate below, you and Skillplay agree to resolve any Disputes through final and binding arbitration.
No Class Actions: You may not file a claim as a plaintiff or a class member in a class, consolidated, or representative action; rather, you may only resolve issues with Skillplay on an individual basis. Our agreement forbids class arbitrations, class actions, private attorney general lawsuits, and consolidation with other arbitrations.
Limitation of Liability: In spite of any statute or law to the contrary, you have one (1) year from the date on which a claim or cause of action arises to file it or it will be permanently barred. This applies to claims and causes of action arising from or connected to your use of Skillplay products or Skillplay Service.
Governing Law & Venue
If during arbitration or by a court of competent jurisdiction any provision of these Terms of Service is determined to be unlawful, void, or for any other reason unenforceable, then that provision shall be deemed severable from these Terms of Service and shall not affect the validity and enforceability of any remaining provisions. A waiver of any provision or right shall not be deemed to have occurred by Skillplay's failure to insist upon or enforce strict performance of any provision of these Terms. No waiver of a provision of these terms shall constitute a subsequent or continuing waiver of that provision or of any other provision.
Entire Agreement
You warrant that you have the authority to enter into an agreement on behalf of any legal entity on whose behalf you use the Service. Unless you have a different formal agreement with Skillplay that expressly specifies it supersedes this Terms of Service, these Terms of Service comprise the entire agreement between you and Skillplay and govern your use of the Service.
Without Skillplay's prior written agreement, you may not assign the Terms of Service, any rights thereunder, or any obligations thereunder, in whole or in part, voluntarily or by operation of law. Without the proper previous written authorization of Skillplay, any alleged assignment or delegation made by you will be void. Without your permission, Skillplay may assign these Terms of Service or any rights granted hereunder.
